The Himachal Pradesh High Court in one of the cases held that the employment on compassionate grounds would be given on the basis of the policy which was in force during the death of the applicant’s father. According to Keith and Kin policy, in the matter related to giving jobs on compassionate grounds, Judge Ajay Mohan Goyal, while passing the above judgment, issued orders to the Road Transport Corporation that the applicant should be regularized with all financial and other benefits from April 10, 2007. According to the facts given in the petition, the father of the applicant, who was working in the Road Transport Corporation, had died on October 25, 2000. But as the applicant was a minor, he could not apply for the job immediately. Applied to the corporation to give him a job. But instead of giving job to the applicant on the basis of regular service, the Road Transport Corporation hired him on contract basis. Prior to the above petition, the petitioner had filed a case before the High Court regarding regularization of the service rendered on contract basis from the date of his service as per the decision passed by the Supreme Court. orders were issued. But the Corporation rejected the applicant’s case on the ground that the applicant’s case was received on 5 February 2007 for giving him a job and as per the amendment made in the Recruitment and Promotion Rules, he could be hired only on contract basis. . The court clarified that when the father of the applicant died on October 25, 2000, there was no provision for giving employment on contract basis. Apart from this, he had already attained the age of majority before the date fixed by the corporation.
