The Himachal Pradesh High Court, while giving important provisions regarding the retirement age of Class IV employees, clarified that Class IV employees who were engaged in government services before May 10, 2001, would retire only on attaining the age of 60 years. Those employees whether regularized or temporarily engaged before the said date, shall be retired only at the age of 60 years.The Court made it clear that if any such employee is retired at the age of 58 years, he should also be deemed to have retired at the age of 60 years and the resultant benefits should be given to him in the form of pension, excluding the salary during this period. The court held that class IV employees being a homogeneous class, there cannot be any discrimination among them regarding the age of retirement. A full bench of Chief Justice Mohammad Rafiq, Justice Ajay Mohan Goel and Justice Jyotsna Riwal Dua gave this important ruling.
