Sanjauli coaching center violates closure orders, faces legal action

Deputy Commissioner Anupam Kashyap has ordered the registration of an FIR against Akash Coaching Institute in Sanjauli for violating disaster management orders that mandated closure of all educational institutions on September 3 and 4, 2025. The coaching center was found conducting classes in defiance of orders issued under the Disaster Management Act 2005.

The district administration received information through social media that Akash Coaching Center was conducting classes for children against the administration’s directives. Following this, Deputy Commissioner Kashyap sent ADM Pankaj Sharma and Tehsildar Apoorv Sharma to inspect the premises on Saturday morning.

Inspection reveals clear violations

When the inspection team arrived at 10:10 AM on Saturday, they found classes in progress at the coaching center. During the investigation, mobile messages from the institute to students about conducting classes were discovered. When questioned, Operation Head Rajesh Kumar claimed that classes were only being conducted for students residing in the institute’s premises and hostel.

However, when students were questioned directly, many were found to be non-residents who had come from outside to attend classes, contradicting the management’s claims. The inspection team prepared a detailed interim report for the Deputy Commissioner, including photographs, videography, and other evidence collected from the site.

The team also inspected another coaching center in Sanjauli, which was found to be properly closed in compliance with the orders.

Swift administrative action

DC Anupam Kashyap took immediate action after reviewing the report, directing the Superintendent of Police to register an FIR against the coaching institute. “We received information about Akash Coaching Center conducting classes. When our team led by ADM reached the spot, classes were ongoing. Violations of Sections 51, 52, and 53 of the Disaster Management Act 2005 were found. Accordingly, instructions have been given to the SP to register an FIR,” Kashyap stated.

He warned that strict action would be taken against any violations of orders issued under the Disaster Management Act 2005 anywhere in the district and appealed to the public to immediately report any rule violations to the administration.

Legal provisions under Disaster Management Act 2005

The violations fall under three specific sections of the Disaster Management Act:

Section 51 – Penalty for obstruction: Provides punishment for obstructing officers or refusing to comply with directions given by central government, state government, or district authorities. Violations can result in imprisonment up to one year or fine, or both. If such obstruction results in loss of life or imminent danger to life, punishment can extend to two years imprisonment.

Section 52 – Penalty for false claims: Addresses false claims made to obtain relief, assistance, repair, reconstruction, or other benefits from authorities following a disaster. Violations are punishable with imprisonment up to two years and fine.

Section 53 – Penalty for misappropriation: Covers misappropriation of money or materials intended for disaster relief. Violations carry punishment of imprisonment up to two years and fine.

This case highlights the administration’s commitment to enforcing disaster management protocols strictly, ensuring public safety during emergency situations takes precedence over commercial interests.
