High Court cancels anticipatory bail in 12-year-old’s death case in Rohru

The Himachal Pradesh High Court has cancelled the anticipatory bail granted to the main accused in the case of a 12-year-old boy’s death in Rohru sub-division of Shimla district. The court made it clear that the bail is not valid due to provisions under Section 18 of the SC/ST Act.

Justice Rakesh Kainthla’s court heard the matter, and the accused may now face arrest in this case. The incident occurred in Limbra village under Chirgaon police station jurisdiction when the minor took his own life on September 16.

Police initially registered a case on September 18 under Sections 107, 127(2), 115(2), and 3(5) of the Bharatiya Nyaya Sanhita. Subsequently, provisions of the SC/ST Act were added when untouchability and caste-based atrocities came to light during investigation.

According to the complaint filed by the child’s mother, three village women brutally beat her son and locked him in a cow shed. Traumatized by this incident, he consumed poison, resulting in his death. While the accused had initially received bail from the High Court, the matter came back for consideration after SC/ST Act sections were added to the case.

The victim’s family has alleged that the child, who belonged to a Scheduled Caste, was subjected to severe torture for touching a house. The allegations state that the boy had touched the house of a village woman named Pushpa Devi, which led to the alleged assault.

On Tuesday, the Himachal High Court rejected the anticipatory bail granted to the accused, potentially paving the way for arrest in this caste atrocity case involving the tragic death of a minor.
