Government proposes 40-year cap on land lease period, 80 years for HIMUDA in draft rules

Himachal Pradesh government has notified draft amendments to land lease regulations, proposing a maximum lease period of 40 years for all types of land, with an exception allowing up to 80 years for leases granted to the Himachal Urban Development Authority (HIMUDA).

The Revenue Department issued the notification for the Himachal Pradesh Lease (Amendment) Rules, 2025, which are being framed under provisions of the Himachal Pradesh Village Common Lands Act, 1974 and the Land Ceiling Act, 1972.

According to the draft, the proposed amendments introduce significant changes to lease duration norms. While the government will not approve leases exceeding 40 years for any category of land under the new framework, the extended 80-year provision for HIMUDA reflects the agency’s role in long-term urban development projects.

The government has published the draft in the official gazette (e-Gazette) and invited objections and suggestions from the general public and stakeholders within 30 days. This public consultation period will allow affected parties to provide feedback before the rules are finalized and implemented.

The amendments represent a standardization of lease policies across different land categories, potentially impacting commercial, industrial, and residential lease arrangements throughout the state. Stakeholders including businesses, developers, and land users are expected to closely examine the implications of the proposed duration limits during the consultation period.
